I acknowledge and agree to the following:
- I am signing this form not only on my own behalf, but also on behalf of the minors referred to below (“the Minors”).
- I confirm that I am the legal guardian of the Minors, alternatively that I am duly authorized by their guardian in all respects relating hereto.
- I acknowledge that The Cavern Berg Resort and Spa provides for certain activities for its guests including but not necessarily limited to hiking, horse riding, tennis, and fishing (“the Activities”) and that, regardless of the care taken by them to avoid injuries, physical activity carries with it certain inherent risks.
- I acknowledge that I enter the property, make use of all the facilities and undertake the Activities at my sole risk. In consideration of permission to make use of The Cavern Resort & Spa’s facilities and partake in the activities, I, personally and on behalf of the Minors, do hereby release, waive, discharge and hold harmless The Cavern Berg Resort and Spa, its owners, directors, employees and agents and/or contractors from any and all liability for any harm, injury, damage, claims, causes of action, costs and expenses that we may have or that may hereafter accrue to me or the Minors arising out of any loss, damage or injury, including death, that be sustained by me or the Minors, or any loss or damage to any property belonging to us whether caused by negligence or howsoever arising.
- I acknowledge that I have read this Indemnity Form and that its terms and conditions have been explained to me to my satisfaction. I further acknowledge that the terms of this Indemnity are fair and reasonable and that I agree to the terms contained herein.
